Terms & Conditions – Online Personal Training App

By creating an account or using this app, you agree to these Terms & Conditions. If you do not agree, please do not use the app.

By creating an account, purchasing any service, or using this app, you confirm that you have read, understood, and agree to these Terms & Conditions. If you do not agree, do not use the app.

 

1. Fitness Only – Not Medical Advice

This app provides general fitness, diet and exercise guidance for educational purposes only. It does not provide medical advice, diagnosis, or treatment.

The personal trainer is not a doctor, physical therapist, or licensed healthcare professional. You should consult a physician before starting any exercise program, especially if you have a medical condition, injury, or health concern.

 

2. Trainer’s Responsibility

The personal trainer’s responsibility is strictly limited to:

  • Providing general fitness instruction, workout plans, and educational content

  • Designing programs based solely on the information you choose to provide

  • Delivering services remotely without in-person or real-time supervision

The trainer does not:

  • Diagnose medical conditions or adjust programs for undisclosed injuries or health issues

 

3. Plan Types & Trainer Involvement

This app offers different types of training plans. You understand and agree that:

  • Only plans that explicitly state they include a personal trainer will involve trainer monitoring, feedback, communication, or program adjustments.

  • Plans that include a personal trainer may be reviewed or modified at the trainer’s discretion and within the scope of the services described at purchase.

  • Pre-made and self-guided plans do not include a personal trainer, are not monitored, and will not be altered for any reason.

  • No trainer will be assigned to pre-made plans, and no customization, feedback, or plan changes will be provided for these plans.

You are responsible for selecting the plan type that best fits your needs and understanding the level of support included before purchase.

 

4. Assumption of Risk (Important)

You understand and acknowledge that participating in physical exercise involves inherent and unavoidable risks, including but not limited to:

  • Muscle strains, tears, or soreness

  • Joint, ligament, or tendon injuries

  • Slips, falls, or equipment-related injuries

  • Cardiovascular events or other serious medical complications

By using this app, you voluntarily and knowingly assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from your participation in any workouts, programs, or activities provided through the app.

 

5. Waiver, Release, and Limitation of Liability

To the maximum extent permitted by law, you agree that:

  • You waive, release, and forever discharge the personal trainer, app owner, and all related parties from any and all claims, demands, damages, injuries, losses, or causes of action arising out of or related to your use of the app.

  • This includes injuries or damages resulting from exercise participation, improper form, overexertion, equipment use, reliance on instructions, or failure to follow safety guidelines.

  • The trainer and app owner shall not be liable for any physical, emotional, or medical injury, whether temporary or permanent, including serious injury or death.

You agree that this waiver applies even if an injury results from ordinary negligence, to the fullest extent allowed by applicable law.

 

6. Your Responsibility

You agree that you are solely responsible for:

  • Ensuring you are physically capable of exercising

  • Using proper form and appropriate equipment

  • Exercising in a safe environment

  • Stopping immediately if you feel pain, dizziness, or discomfort

 

7. No Guarantees

Individual results vary. No specific fitness, weight loss, strength, or health outcomes are guaranteed.

 

8. All Sales Are Final

 

All purchases made through this app are final and non-refundable. This includes, but is not limited to: Subscriptions, Training Programs, Digital Content, and Promotional Offers.

 

 

Refund Policy: No refunds will be issued for unused services, lack of results, dissatisfaction, or change of mind.

 

Right to Cancel: By purchasing digital content or starting a service immediately, you expressly request that the service begins within the 14-day cancellation period and acknowledge that you thereby waive your statutory 14-day right to cancel.

 

Statutory Rights: This policy does not affect your statutory rights in the event that the digital content is faulty or significantly not as described.

 

Cancellations: You may cancel auto-renewals yourself within the app or contact WelshyPT to cancel on your behalf. Cancellations must be made at least 24 hours before the renewal date to avoid further charges.

 

9. Account Access

We reserve the right to suspend or terminate your account if these Terms are violated or the app is misused. No refunds will be issued in such cases.

 

10. Changes to These Terms

These Terms may be updated at any time. Continued use of the app means you accept the revised Terms.
